The aim of this article is to argue and explain the dislocation of the human rights discourse with regard to migrant children detained in Mexico. First, it looks theoretically at the dislocation of the human rights discourse regarding migrants in general. Second, it analyzes the construction of the discourse of migrant children's human rights starting from three premises: 1) children have rights and need states to adopt special measures for their protection due to their age; 2) all children have all rights; and, 3) children can only be detained as an absolutely exceptional measure of last resort. Third, the author delves into the normative and practical dislocation of the discourse about migrant children's human rights in Mexico. And fourth, she proposes three possible alternatives (legal, practical, and political) for articulating the discourse of migrant children's human rights to protect them and defend their rights. ; Este artículo tiene por objetivo argumentar y fundamentar la dislocación del discurso de derechos humanos respecto a la niñez migrante detenida en México. Para estos fines, primero estudia teóricamente la dislocación del discurso de derechos humanos hacia las personas migrantes. Segundo, analiza la construcción del discurso de los derechos humanos de los niños migrantes mediante tres premisas: 1) los niños son sujetos de derecho y requieren que los Estados adopten medidas especiales para su protección debido a su edad; 2) todos los niños, todos los derechos; y 3) la detención de niños sólo puede llevarse a cabo como medida de último recurso y absolutamente excepcional. Tercero, aborda la dislocación normativa y práctica del discurso de derechos humanos de los niños migrantes en México. Y, cuarto, propone tres alternativas posibles –en materia legal, práctica y política– para articular el discurso de derechos humanos de los niños migrantes con el fin de que pueda usarse para protegerlos y reivindicar sus derechos.

This article aims to argument the dislocation of the human rights discourse in relation to migrant children detained in Mexico. For those purposes, first the dislocation of the human rights discourse for migrant persons will be theoretically studied. Second, the construction of the human rights discourse of migrant children through three premises will be analyzed: 1) children are subjects of law and require that States adopt special measures for their protection due to their age; 2) all children, all rights; and 3) children detention can only be used as a last resource and absolutely outstanding measure. Third, normative and practical dislocation of the human rights discourse of migrant children in Mexico will be approached. And fourth, three possible alternatives –legal, practical and political– for the articulation of the human rights discourse for migrant children will be proposed so that it can be used to protect them and claim their rights.

Summary This article aims to argue and substantiate the dislocation of the human rights narrative with regard to the migrant girl detained in Mexico. To this end, it first theoretically explores the dislocation of human rights discourse towards migrants. Second, it analyses the construction of the human rights narrative of migrant children through three premises: (1) children are subject to law and require States to take special measures for their protection on account of their age; (2) all children, all rights; and (3) detention of children can only be carried out as a measure of last resort and absolutely exceptional. Third, it addresses the regulatory and practical dislocation of the human rights narrative of migrant children in Mexico. Fourth, it proposes three possible alternatives — in legal, practical and political terms — to articulate the human rights narrative of migrant children so that they can be used to protect them and assert their rights. ; Resumen Este artículo tiene por objetivo argumentar y fundamentar la dislocación del discurso de derechos humanos respecto a la niñez migrante detenida en México. Abstract
Detention facilities are no place for children who are irregular migrants. Yet both the United States (US) and Mexico have struggled with how to respond to the arrival of Central American children who are primarily fleeing violence. In these neighbouring countries, the detention of children reflects both an ineffective and misguided strategy to deter people from moving across their southern borders. This focus on border control is further reinforced by the US outsourcing of enforcement controls to Mexico. In the US, a preoccupation with border control can quickly undermine the purported interest of protecting migrant children because they lack the fundamental right to be free from detention. In Mexico, its role as a buffer State causes it to overlook its human rights, constitutional, and federal law commitments to the fundamental rights of children, while allowing practical obstacles to stand in the way of these legal obligations. This article examines how the political imperative of border control in the US influences the various approaches taken by the US and Mexico towards the detention of migrant children. It analyses the shortcomings and best practices of each system and concludes with recommended reforms that actualize the right of migrant children to be free from detention.
